Healthcare Law

In addition to the ordinary concerns that apply to all business transactions, healthcare sector companies and their transactions are subject to additional scrutiny for compliance with state and federal restrictions on referrals and other prohibited economic relationships. For example, the federal Stark regulations and anti-kickback statutes are implicated by any arrangement or relationship that involves any federal health care program (Medicare or Medicaid). California has additional, distinct, and broader statutory rules governing health care providers’ business relationships. The repercussions for the violation of these statutes can include criminal and civil penalties, as well as exclusion from participation in federal health care programs. For these reasons, it is important that practitioners in the healthcare arena have a basic grasp of the laws, how they are enforced, as well as safe harbors, exceptions, and practical applications.

Pharmacy

Pharmacies require an attorney who understands the independent retail pharmacy business. An attorney must coordinate knowledge of compliance and the business of running a pharmacy.

Prior to representing pharmacy clients as an attorney, I worked at a retail pharmacy. Presently, I represent independently owned pharmacies, including retail, compounding, wholesalers, and long term care pharmacies in business and regulatory matters relating to the California Board of Pharmacy, DEA, and FDA.

Home Health

Representing Home Health companies requires experience working in a field with Joint Commission compliance standards. Joint Commission surveyors visit accredited health care organizations a minimum of once every 39 months to evaluate standards compliance. All regular Joint Commission accreditation surveys are unannounced. That is why it is imperative to be prepared and compliant.

I have experience advising my home health clients from formation, through surveys and up until the company sale.
